Terms of Service

1. Acceptance of Terms

By accessing or using the Botski platform (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.

Botski reserves the right to update and modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the Service after any modifications constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes via email or in-app notification.

2. Description of Service

Botski provides an AI-powered sales workforce platform that includes five specialized AI bots — Penny (Meeting Copilot), Quill (Outbound Writer), Marv (Pipeline Analyst), Scout (Inbound Qualifier), and Rosa (Renewal Manager). The Service includes meeting preparation, outbound messaging, pipeline analysis, lead qualification, renewal tracking, and related sales intelligence features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, bot, or integration. We will make reasonable efforts to provide advance notice of any material changes that may affect your use of the Service.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. Botski is not liable for any loss or damage arising from your failure to protect your login credentials. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in prohibited activities.

4. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to:

  • Using the Service to send spam, phishing attempts, or unsolicited commercial communications
  • Attempting to reverse engineer, decompile, or extract the source code of the Service or its AI models
  • Using the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Attempting to gain unauthorized access to the Service, other user accounts, or related systems
  • Interfering with or disrupting the integrity or performance of the Service
  • Using automated means (bots, scrapers, etc.) to access the Service without our express written permission
  • Exceeding any usage limits or quotas associated with your subscription tier

5. Intellectual Property

The Service, including its original content, features, functionality, and design elements, is owned by Botski and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The Botski name, logo, and bot names (Penny, Quill, Marv, Scout, Rosa) are trademarks of Botski Inc.

You retain ownership of the data, content, and materials you upload or input into the Service (“Your Content”). By using the Service, you grant Botski a limited, worldwide, royalty-free license to use Your Content solely as necessary to provide the Service to you, including processing by our AI bots.

Output generated by our AI bots may not be unique and may produce similar results for other users. You are responsible for reviewing and verifying AI-generated content before relying on it for business decisions.

6. Payment and Billing

Certain features of the Service are available on a paid subscription basis. By selecting a paid plan, you agree to pay all applicable fees as described at the time of purchase. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

We may change our fees upon 30 days' notice. Such notice may be provided by email or through the Service. Your continued use of the Service after a fee change constitutes acceptance of the new fees. We use third-party payment processors and do not store your full payment card details on our systems.

7. AI Bot Disclaimer

Botski's AI bots use machine learning models to generate suggestions, summaries, drafts, and analyses. While we strive for accuracy, AI-generated content may contain errors, omissions, or biases. The Service is intended to augment — not replace — human judgment in sales and business decisions.

YOU ACKNOWLEDGE AND AGREE THAT AI-GENERATED OUTPUT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. You are solely responsible for reviewing, verifying, and approving any content generated by our AI bots before using it in your business operations or communications with third parties.

8. Third-Party Integrations

The Service may integrate with third-party platforms (CRM systems, calendar services, email providers). Your use of such integrations is subject to the terms and privacy policies of those third-party providers. Botski is not responsible for the availability, accuracy, or practices of any third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTSKI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF BOTSKI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BOTSKI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO BOTSKI IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOTSKI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Botski and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. Upon your request, we will delete or anonymize your personal data in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the federal and state courts located in San Francisco County, California.
